1. Acceptance of Terms
By creating an account, accessing, or using the Blockvance mobile application ("App") and website, you agree to be bound by these Terms of Service. Blockvance, Inc. ("Blockvance," "we," "us") allows users to track financial health and access earned wages ("Instants") subject to these conditions.
2. Integration with Financial Institutions
Blockvance is not a bank. We use Plaid Inc. ("Plaid") to gather your data from financial institutions. By using the Service, you grant Blockvance and Plaid the right, power, and authority to act on your behalf to access and transmit your personal and financial information from your relevant financial institution. You agree to your personal and financial information being transferred, stored, and processed by Plaid in accordance with the Plaid End User Privacy Policy.
3. "Instants" (Earned Wage Access)
Blockvance "Instants" are non-recourse cash advances based on your anticipated income.
- Not a Loan: Instants have no mandatory repayment timeframe, no interest, and no APR.
- Non-Recourse: Blockvance has no legal or contractual claim against you for repayment. If you do not repay an advance, we will not engage in debt collection activities, report you to credit bureaus, or sue you. However, you will be effectively banned from using the Service for future advances.
- Fees are Optional: Tipping is voluntary. Expedited transfer fees ("Turbo Fee") are optional; standard ACH transfers (1-3 days) are free.
4. Electronic Fund Transfers (EFTs)
By linking your bank account, you authorize us to electronically debit and credit your account via the Automated Clearing House (ACH) network. You verify that the linked bank account is in your name. If a debit is returned for insufficient funds (NSF), strictly for the repayment of an Instant, Blockvance will not charge you an overdraft or NSF fee. However, your bank may charge you fees, for which we are not responsible.
5. User Eligibility
To use Blockvance, you must: (a) be at least 18 years old; (b) reside in the United States; (c) have a compatible bank account supporting incoming/outgoing ACH transfers; and (d) verify your identity as required by federal law (KYC/CIP regulations).
6. Limitation of Liability
The Services are provided "as is" without warranties of any kind. Blockvance shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses resulting from your access to or use of the service.
7. Dispute Resolution & Arbitration
Any disputes arising out of or in connection with these Terms shall be resolved by binding individual arbitration in accordance with the rules of the American Arbitration Association. You explicitly waive your right to participate in a class action lawsuit.
